Pak Waltan is an Associate Director of LVM Law Chambers LLC (“LVM”), and a key member of LVM’s Insurance Disputes team, with 15 years of insurance dispute experience having practiced in boutique insurance firms including B Rao & K S Rajah and United Legal Alliance LLC, as well as in Rajah & Tann LLP.

During her formative years in Rao & K S Rajah, Waltan independently handled a wide range of insurance related matters involving, amongst others, property damage and personal injury claims, workmen’s compensation claims, as well as public liability cases.  In particular, she assisted in defending the claim made by Ms Andrea D’cruz against the importers and distributors of the infamous Slim10 pills.

At Rajah & Tann, Waltan was privileged to work in the Insurance Department helmed by Mr. Quentin Loh S. C., before he was elevated to the High Court bench.  Waltan subsequently joined United Legal Alliance LLC, another boutique insurance practice where she was an Associate Director in the General Insurance Litigation Department for 8 years.

Case Highlights

Waltan specialises in general insurance litigation, and has been instructed by major insurers in Singapore on the following:

(A) Professional indemnity insurers to act on behalf of, among others:

  • An Architect in a professional negligence claim against him by a club who claimed that the Architect’s design failed to comply with the Fire Code and was allegedly unfit for its purpose;
  • A firm of auditors against a claim made by their clients, a leading company in the luxury watches and accessories industry, for failing to discover a fraud committed on the company by the company’s accounts manager;
  • Several engineers against claims made by the owners of adjacent properties who claimed that their properties were damaged due to the engineer’s alleged failure to properly design / supervise excavation works premises under construction; and
  • Several solicitors who were sued by their clients for allowing their matters to become time barred and / or deemed discontinued.

(B) She has also been instructed by public liability insurers to represent, amongst others:

  • Contractors of construction projects where injury and / or property damage was caused to third parties or lawful entrants into the project site;
  • Various occupiers of shopping malls / shop units where shoppers sustained injuries arising out of slip and fall incidents and accident caused by allegedly defective premises;
  • A large food court chain in Singapore whose pipe flushing works caused water damage to occupiers of neighbouring shops;
  • A local pastry chain whose customers sustained food poisoning;
  • The managing agents of various recreational clubs in Singapore whose members / guests sustained injury due to defective premises and / or the negligence of the clubs’ employees;
  • Various Town Councils against claims made by members of the public who alleged that they sustained injuries arising out of slip and fall incidents / accident caused by defective premises / fallen trees; and
  • Management Corporation Strata Titles of several condominiums and strata buildings for damage caused to subsidiary proprietors’ property;

(C) Waltan also has experience investigating and understanding the technical aspects of construction matters as she was required to represent various developers and contractors insured under Contractors’ All Risk Policies / Erection All Risks Policies against claims for property damage and personal injury caused in industrial accidents, including cranes / scaffold structure collapse fire and / or explosion and landslip incidents.

(D) In addition, Waltan has assisted insurers in recovery actions for performance bonds / guarantees, statutory recovery under the Work Injury Compensation Act (Cap 354) and subrogation claims.

Besides litigation matters, Waltan has also advised insurers on the efficacy of a wide range of policy terms, including motor insurance policies, travel insurance policies, home contents / burglary policies, errors and omissions policies, fidelity policies.  She has also advised local and foreign Insurers and Insurance Intermediaries on various regulatory matters, such as compliance with the Insurance Act (Cap 142) and Financial Advisers Act (Cap 110).
